Motion: Councillor B. Dennehy - Options available to FCC to ensure the

cluster of derelict buildings at Skerries Corner, Mainstreet Rush

are cleaned up.

“That the Chief Executive confirm and outline the timelines and

sequence of actions available to Fingal County Council to counteract

and combat the flagrant disregard of the owners of the derelict

properties adjacent to Skerries Corner, Rush to the Programme of

Works agreed on the 15th of January 2019 with Fingal County Council.”

Report:

The timeline for the completion of works outlined in correspondence and

at site meeting to the owners of the properties on Main Street, Rush has

lapsed without any works commencing or any indication of works

commencing. Accordingly, the Council served a Section 8(2) Notice of

Intention under the Derelict Sites Act 1990 on the 1st April 2019 to make

an entry on to the Derelict Sites Register. As no formal reply to this

Statutory Notice has been received within the specified time and no works

have commenced, the Council is advancing the necessary statutory

process to add the site to Derelict Sites Register.

Once a site is added to the Derelict Sites Register an annual levy of 3% of

the market valuation of the site is charged to the owner with this levy to

increase to 7% with effect from January 2020.

Other legislative options available to the Council such as the Vacant Sites

Levy and Sanitary Services Act are also under consideration.
