Question: Councillor B. Dennehy

“To ask the Chief Executive to confirm the levy imposed on the site of the

proposed commercial development on the main street, Rush under the

Derelict Sites Act is in place, accepted and the monatery value of the

levy?”

Reply:

As outlined in previous replies to the Balbriggan/Swords Area Committee

statutory notices to enter the site on the Derelict Sites register have issued

to the site owner under the Derelict Sites Act. A Section 22 Notice issued on

the 12th November 2019 with respect to the valuation of the site which is a

statutory requirement as enforcement advances to the next stage under

the Derelict Sites Act. The site owner was advised that an annual levy

equating to 7% of the market valuation of the site can be charged.

Any appeal on a site valuation on a Section 22 Notice is made to the

Valuation Tribunal and must be made within 28 days of the issue of the

Section 22 Notice. To date, the Council has not been made aware of any

such appeal in this case.
