"To ask the Chief Executive if there is any mechanism available to

members to make

particular to the infrastructural element in order to make provision for the

large increased transport needs in Fingal?”

Reply:

The process to review, prepare and vary any Development Plan is outlined

in Part II, Chapter I (Sections 9 -13) of the Planning and Development Act,

as amended. Section 13 of the Act is the statutory process for any

variation (or adjustments) to the Development Plan.

The facility to vary a Development Plan exists for instances when a

Planning Authority may wish to adjust the objectives and policies of a

development plan in order to take account of different circumstances or

issues unforeseen at the time of the original making of the development

plan. In making a variation to the Development Plan, the variation and

other parts of the Plan must remain internally consistent.
